Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorarified Mandamus calling for the records of the 2nd respondent dated 26.07.2021 and quash the same and consequently direct the 2nd respondent to permit the petitioner for the next stage of selection for the post of Grade-II Police Constable and Grade-II Jail warder and Fireman 2020.

ORDER

The petitioner has challenged the impugned disqualification order/slip dated 26.07.2021 issued by the 2nd respondent.

2. According to the petitioner, in the previous selection the petitioner's height was recorded as 170 cm whereas the respondents by the impugned disqualification slip stated that the petitioner height is 169 cms.

3. The learned counsel for the respondents submits that the physical measurement of height were carried out manually during the previous selection, whereas now two measurements were carried out one by manual and the other with the help of digital machine.

4. Already this Court has granted relief to some of the successful candidates by allowing them to participate in second round of physical test along with those who should not appeared due to Covid-19. Since the petitioner seems to have a plausible case for being appointed to the post of Grade-II Police Constable, as a last chance, the petitioner is given one more opportunity to appear along with those candidates.

5. The respondents shall issue Intimation Letter to the petitioner to participate in the physical test to be conducted on 22.09.2021 in Trichy. The petitioner is directed to appear for physical test of height only. It is made clear that the said opportunity will be the last opportunity for the petitioner. The respondents are also directed to keep in mind the Judgment of the Full Bench of this Court passed in W.A.Nos.8 to 12, 14 to 16, 23 & 24 of 2020 dated 29.01.2020.

6. This Writ Petition stands disposed of with the above observations. No costs. Consequently, connected Miscellaneous Petitions are closed.
