Respondent PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the learned Chief Judicial Magistrate, Puducherry to consider the bail application that may be preferred by the petitioner in crime No.11 of 2020 on the file of the respondent police namely the Inspector of Police, Cyber Crime Cell, Puducherry on the same day of his surrender.

This Criminal Original Petition has been filed seeking direction to direct the learned Chief Judicial Magistrate, Puducherry to consider the bail application that may be preferred by the petitioner in Crime No.11 of 2020 on the file of the respondent police on the same day of his surrender.
2. Heard Mr.Prakash Adiapadam, learned counsel for the petitioner and Mr.D.Bharathachakravarthy, learned Additional Public Prosecutor (Puducherry) appearing for the respondent.
3. Today when the matter came up for hearing, learned Additional Public Prosecutor (Puducherry) appearing for the respondent would submit that during the time of occurrence, the petitioner and others by using whatsapp facility promoting enmity between different groups on grounds of religion, race and doing acts prejudicial to maintenance of harmony. further submit that since the offence committed by the petitioner is against the nation, it needs detailed enquiry and therefore, if the application filed by the petitioner is allowed in his favour, it would cause prejudice to the investigation done by the respondent.
4. Recording the said submission and also considering the gravity of offence committed by the petitioner, this Criminal Original Petition is dismissed. No costs.
