ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 03.07.2021 for the alleged offences punishable under Sections 376, 506(i) of IPC, in Crime No.11 of 2021, on the file of the respondent police, seek bail.
2. The case of the prosecution is that the petitioner and the victim girl are neighbours. While so when the victim girl was along in her house the petitioner sexually assaulted her and thereby she became pregnant. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is a innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) would submit that the petitioner compelled the victim girl to have sex with her and also threatened her with dire consequences. petitioner is released on bail, definitely he will threaten the victim girl, accordingly he prayed for dismissal of the petition. He further submits that the statement of the victim girl under section 164(5) of Cr.P.C was recorded. Hence, he vehemently opposed for grant of bail to the petitioner.
5. On a perusal of the statements recorded under section 164(5) of Cr.P.C it is clear that the petitioner sexually harassed the victim girl.
6.Considering the nature of offence committed by the petitioner , this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. -sd/- 11/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
