Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Certiorarified Mandamus, calling for the records pertaining to issuance of impugned order vide Application No. issued by the second respondent and quash the same and consequently direct the respondents to issue a Class-II legal heir certificate to the petitioner.

ORDER

The petitioner is the nephew of the deceased. The petitioner seeks for legal heirship certificate as a Class-II legal heir for his deceased uncle.

2. The Full Bench of this Court by its order dated 17.06.2022, directed the respondents therein, to issue a circular within a period of six (6) weeks from the date of the order with regard to the requirements for legal heirship certificate/relationship certificate for Class-II legal heirs. The period has not come to an end.

3. However, the learned counsel for the petitioner submits that the petitioner may be granted liberty to approach the respondent in accordance with the proposed circular to be issued by the respondents pursuant to the directions given by the Full Bench of this Court. The said statement is recorded.

4. In view of the above submission made by the learned counsel for the petitioner, this Writ Petition is disposed of, by granting liberty to the petitioner to approach the authority concerned in terms of the proposed circular to be issued by the authority concerned, in terms of the decision of the Full Bench of this Court on 17.06.2022 passed in WP.No.25247 of 2021 etc., batch.
