Complaint has been registered in Cr.No.31 of 2023 against this petitioner for offence under Sections 406, 409, 420, 34 and 506(i) of 1/4

IPC. The case of cheating promising to sell residential plots, the petitioner herein been arrested and confined in prison for 40 days, pending investigation, he has given a representation on 23.05.2024 to the Commissioner of Police stating that the respondent police harassing him under the guise of investigation.

2. The learned Government Advocate (Crl.Side) states that since several complaints been received, the petitioner been called for enquiry regarding this complaint. Except that, there is no harassment as alleged.

3. The learned counsel for the petitioner submitted that the respondent police is threatening to file fresh FIR against him.

4. The records indicates that as on date, except Cr.No.31 of 2023, no further FIR has been registered against this petitioner in connection with money transaction which is subject matter of Cr.No.31 of 2023. While so, the apprehension of the petitioner is ill-found. In any event, if there is any fresh complaint of similar nature, no doubt, the respondent police shall take those complaint as additional information and proceed.

5. With the above direction, this Criminal Original Petition is disposed of .
