This application has been filed to condone the delay of 283 days in filing the written statement of the 9th defendant.

2. In the affidavit filed in support of the Judges Summons, it is stated that considerable time was taken to trace the records and documents could not be immediately traced and handed over to the counsel to prepare the written statement. In this process, there has been a delay.

3. Heard the learned counsel for the plaintiff also.

4. Taking all the factors into consideration, this application stands allowed and the delay is condoned.
