ORDER
The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 61(2), 316(2), 318(4) of BNS and Section 5 of the Protection of Interest of Depositors (In Financial Establishment) Act, 1997 and Section 21(3) of the Banking unregulated deposits Scheme Act, 2019, in Crime No.1 of 2026, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner/A4, along with other accused, induced the defacto complainant and several depositors to invest money in the company run by the accused and thereafter cheated them to the tune of several lakhs of rupees. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.
4. Per contra, the learned Government Advocate (Crl.side) submitted that the petitioner had actively participated in the collection of deposits from the public and the investigation is at a crucial stage. Hence, he opposed to grant bail to the petitioner.
5. Considering the submissions made on either side and on perusal of the materials available on record, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
6. Accordingly, this Criminal Original Petition is dismissed. 06.05.2026 kmm
