ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Section 430, 379 IPC r/w section 36(A) of Mines and Minerals Act, in Crime No.185 of 2021 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioner were involved in illegal transportation of 3 units of river sand by using tipper lorry.
3.The learned counsel appearing for the petitioners would submit that the petitioners are an innocent persons and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate would submit that this is the second bail application filed by the petitioners and this Court has already dismissed the earlier bail application of the petitioners. The https://hcservices.ecourts.gov.in/hcservices/
petitioners along with other accused person have illegally transported 3 units of river sand by using tipper lorry and also there are eight previous cases pending against the first petitioner. Hence, he vehemently opposed for grant of bail to the petitioners. 5.Considering the gravity of offence made by the petitioners, this Court dismissed the earlier bail petition and there is no change of circumstances, this Court is not inclined to grant bail to the petitioners.
