This Writ Petition has been filed for issuance of a Writ of Mandamus directing the 1st respondent to pass an order on the complaint made by petitioner's mother Sarasammal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on 28.02.2004.

The case of the petitioner is that his mother Sarasammal left him with her daughters due to indoctrination made by her daughters petitioner's mother purported to have lodged a complaint with the 2nd respondent District Social Welfare Officer, Thiruvallur District on 28.02.2024. The officer made an enquiry under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The Sub Collector, Ponneri also conducted an enquiry and directed the petitioner, his brother and his sisters to pay a sum of Rs.4,000/- per month. The petitioner and his brother agreed to the said order. Despite that the petitioner's mother often visited the petitioner's house along with daughters Punitha and Mala. They also unleashed atrocities and made life threaten to the petitioner. The petitioner also faced enquiries at the hands of Kavaraipetti Police Station at the instance of the petitioner's mother, her daughters, grand daughter and her husband. 21.05.2024 requesting the 1st respondent Collector to pass order on the complaint of petitioner's mother under Senior Citizen Act. As no response from the 1st respondent till date, the present Writ Petition has been filed.

3. Heard Mr.J.Nagarajan, learned counsel appearing for the petitioner and Mr.M.Shahjahan, learned Special Government Pleader appearing for the respondents 1 and 2.

4. Learned Special Government Pleader appearing for the respondents 1 and 2 submitted that necessary orders will be passed after considering the petitioner's mother representation.

5. Considering the facts of the case, this Court without expressing any opinion on the merits of the case, directs the 1st respondent to consider the complaint made by the petitioner's mother Sarasammal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 dated 28.02.2024 by affording an opportunity of personal hearing and pass orders within a period of four months from the date of receipt of a copy of this order.

With the above observation, this Writ Petition is disposed of. There shall be no order as to costs.
