ORDER : The Court Made the following order :- The petitioner seeks bail under Section 439 Cr.P.C. for the alleged offences under Sections 8(c ) r/w 20(b) (ii) (B) of NDPS Act.
2. Heard both sides.
3. According to the prosecution, the petitioner was found in possession of 4.5 kgs of ganja and he obtained the same for the purpose of sale. He was arrested on 01.11.2017 for the said offence. Investigation is still pending in this case.
4. The learned counsel for the petitioner would submit that the petitioner has been falsely implicated in this case and that he has not committed any such offence as alleged by the prosecution and that he has been in custody from 01.11.2017 and that therefore, he prayed grant of bail to the petitioner.
5. The learned Government Advocate (Crl. Side) would submit that the property involved in this case has been recovered and there is no previous case against the petitioner. However, he opposed grant of bail to the petitioner.
6. Having regard to the fact that the petitioner has been in custody since 01.11.2017, that the property involved in this case has been recovered and that further incarceration of the petitioner
is not necessary for filing of the final report and the petitioner has no previous case against him, this Court is inclined to grant bail to the petitioner subject to the following conditions.
7. (i) Bail is granted.
(ii) Petitioner is ordered to be released on bail on his executing a bond for Rs.10,000/- each with two sureties each for the likesum to the satisfaction of the learned EC and Special Judge of Coimbatore.
(iii) Petitioner shall report before respondent police at Valparai, daily at 10.30 a.m. for a period of two months and thereafter, as and when required for interrogation. -sd/- 06/12/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
