This Petition has been filed to condone the delay of 138 days in preferring the above Appeal against the decree and judgment dated 13.10.2023, passed in the Suit in O.S.No.405 of 2018 on the file of the II Additional District Judge, Salem.

2.Heard the learned counsel for the Petitioner and the learned counsel for Respondents 1 to 5. Eventhough R6 & R8 were served, no one represented on behalf of them.

3.Having been satisfied with the reasons stated in the affidavit filed in support of this Petition and the submissions made by the learned counsel for the Petitioner, this Petition is ordered as prayed for.

4.Registry is directed to number Appeal, if it is otherwise in order and post the Appeal on 01.08.2024.
