This application coming on this day before this court for hearing the court made the following order:
This application is filed to allow the plaintiffs to amend the plaint. Since the proposed defendants already impleaded in the suit necessary allegation as against them to be made in the prayer column hence application the prayer as against the defendants.
2. The only objection of the respondents is that while filing application for impleading, they have not made allegation to the effect that newly added defendants have changed the Revenue records in respect of the suit property. Now, they wanted to introduce the relief as against new defendants. Newly added defendants were impleaded in the suit only on the basis of the defence taken by the second defendant. Newly added defendants are said to be in possession of the property. Now amendment sought to be made in the plaint is in the nature of consequential nature. This amendment will not change the nature of the suit. Having impleaded the defendants, it is necessary for the plaintiff to amend the plaint for proper adjudication of lis between parties.
3. Therefore, I am of the view that the amendment will not change the nature of the case and the cause of action and it will not prejudice the defendants and impleaded defendants can very well file their written statement.
4. With the above observations, this application is
allowed.
5. The learned counsel for the plaintiff is directed to carryout amendment and file the amended plaint copy by 28.02.2017 and also to serve a copy of the same to the impleaded defendants for filing written statement on their side by then.
6. Post the suit on 28.02.2017.
