This Criminal Original Petition has been preferred, seeking to call for the records in Crime No.446 of 2021 on the file of the first respondent and to quash the same.

The learned Additional Public Prosecutor has submitted that this is a case in counter. There is a dispute pending between the petitioner's group and the defacto complainant's group. Subsequently, the 2nd respondent has also given a complaint and on the basis of which, the present FIR has been registered.

On perusal of the FIR, it is seen that the petitioner's group and the 2nd respondent have given complaints in respect of the offence which was said to have occurred on 24.06.2021. It is a case in counter and two FIRs have been registered on the complaint given by two opposite parties, with regard to the same occurrence. Hence, the 1st respondent police has to follow the standing guidelines given in the Police Standing Order 566(2) and investigate both the cases simultaneously and file a report by finding out who is the aggressor.

With the above observation, this Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed.
