C.M.P.No.17702 of 2019 in CROS. OBJ (SR) No.40000 of 2018 R.MAHADEVAN, J.

This petition is filed to condone the delay of 227 days in representing the Cross Objection.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent / Insurance Company, who has no objection in condoning the delay.

3. Having regard to the reasons stated in the affidavit filed in support of this petition and being satisfied with the same and also no objection expressed by the learned counsel for the respondent/insurance company, the delay of 227 days in representing the Cross Objection is condoned.

However, it is made clear that in the event of the petitioner succeeding in the cross objection, he is not entitled for interest in respect of the delayed period.

4. This petition is ordered accordingly.

Office is directed to number the Cross Objection, if it is otherwise in order and list the same in the usual course along with C.M.A.No.3469 of 2017.
