A.Nos.2920, 2921 & 2922 of 2024 have been filed to condone the delay of 711 days in preferring the Application to set aside the abatement of proceedings against the deceased erstwhile 6th defendant, Late Mr.A.A.Annaprabu in C.S.No.600 of 2011; to set aside the abatement and to bring on record the proposed respondents herein as the legal representatives of the deceased erstwhile 6th defendant, Late Mr.A.A.Annaprabu.

2. Though the proposed respondents have not been served till date, I have heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. The learned counsel for the first respondent fairly concedes that he has no serious objections in allowing all these Applications.

4. The suit is for substantial reliefs of delivery of vacant possession. In any event, summons would be served after impleading the proposed respondents/legal heirs of the deceased 6th defendant, Late Mr.A.A.Annaprabu. rkp Applications and I am satisfied with the reasons assigned for the delay in not filing these Applications in time. Accordingly, these Applications are allowed.

5. The learned counsel for the plaintiff is directed to carry out the necessary amendments in the cause title and file an amended copy of the plaint.

6. Summons to the newly impleaded defendants 9 & 10, returnable by 13.08.2024. Private summons is also permitted.
