ORDER
This writ petition is filed for the following relief: "To direct the Respondents to disburse the belated payment of interest amount of Provident Fund, Gratuity
and Earned Leave salary amounts and other unsettle benefits of E.L. Surrender for the year 2009-2011 and 2017-2018, Arrears amount of 12(3) wage settlement Arrears and 7 days last month salary with effect from 24.11.2021."
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner joined the service of the respondent corporation as Driver on 05.07.1997 and retired on 24.11.2021 as a Selection Grade Senior Driver. It is the contention of the petitioner that he is entitled to the interest amount for the belated payments and other unsettled benefits and arrear amount as per the Section 12(3) settlement. He further submits that retirement benefits like earned leave surrender for the year 2009-2011 and 2017-2018 and salary for last 7 days of service had not been paid. He was also not paid the arrear amounts as per the 12(3) wage settlement.
4. Therefore, the petitioner had made a representation to the respondent to pay him the interest for the belated payment of gratuity, earned leave and provident fund and the unsettled surrender leave salary and arrears amount as per 12(3) settlement and 7 days last month salary.
However, the same had not been considered to date by the respondent. Hence, the petitioner is before this Court.

Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation dated 25.02.2026 has not been considered to date by the Respondent, a mandamus, is therefore, issued to the respondent to pay the interest at the rate of 6% p.a., for the belated payment of the petitioner's Earned Leave Salary, Gratuity Amount and Provident Fund and disburse the unsettled benefits of E.L.Surrender for the year of 2009-2011 and 20172018 and arrears amount as per the 12(3) settlement along with interest at the rate of 6% per annum and 7 days last month salary with effect from 24.11.2021, within a period of one month from the date of receipt of a copy of this order.
6. Accordingly, this Writ Petition is allowed. There shall be no order as to costs.
