..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents 2 and 3 to settle the compensation in connection with the acquisition by the respondents in the year 2011 pertaining to 2 housing plots namely Plot No.10, in all measuring 2370 sq.ft. and plot No.11 in all measuring 2100 sq.ft. situated at Janaki Nagar, Oragadam Village, Sriperumbudur Taluk Comprised in S.No.16/105(16/2 -A-1), Block No.2 Covered by sale deeds vide document No.2522 and 2523 of 1994 on the file of the Sub Registrar, Walajabad to the petitioner.

O R D E R

This Writ Petition is filed seeking for a direction to the respondents 2 and 3 to settle the compensation in connection with the acquisition by the respondents in the year 2011 pertaining to 2 housing plots namely Plot Nos.10 and 11 situated at Janaki Nagar, Oragadam Village, Sriperumbudur Taluk Comprised in S.No.16/105(16/2 -A-1), Block No.2 Covered by sale deeds vide document Nos.2522 and 2523 of 1994 on the file of the Sub Registrar, Walajabad to the petitioner.

2.According to the petitioner, he purchased the above said two plots of lands, which was later acquired by the 2nd respondent on 01.06.2011 for a meagre sum of Rs.4,637/- as compensation for the entire extent. The market value of the said land is at Rs.1.5 to 2 Crores at the time of acquisition by SIPCOT. Hence, the petitioner approached the 2nd respondent for revision of the said compensation to the present market value. Since, the respondents did not reply to the notice dated 03.12.2019 sent by the petitioner nor tried to resolve the issue, the petitioner has come up with the present Writ Petition.

3.Learned counsel for the petitioner would submit that all the persons whose lands were acquired by the SIPCOT, had already received the compensation and so far, only the petitioner was not paid with any compensation. Hence, he has filed the present Writ Petition, seeking for a direction to the respondents 2 and 3 to settle the compensation in connection with the lands acquired by the said SIPCOT.

4.Mr.T.K.Saravanan, learned Additional Government Pleader, who appears for the 1st respondent and Mr.Abishek Murthy, learned Standing Counsel who appears for the 2nd respondent would submit that already the petitioner's compensation amount for the land acquired was determined and has also been deposited into the revenue account, which the petitioner can withdraw at any point of time. However, for enhancement of the compensation determined by them, the petitioner has to approach the District Collector/1st respondent with appropriate representation.

5.Heard the learned counsel on both sides and perused the entire materials available on record.

6.Considering the submissions of the learned counsel for the respondents, as the compensation amount of the petitioner has already been deposited into the revenue account, the competent authority is directed to disburse the said compensation amount along with accrued interest to the petitioner immediately. As far as the enhancement of compensation is concerned, the petitioner is at liberty to approach the District Collector in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. 7.With the above direction, this Writ Petition is disposed of.
