ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294b, 341 and 302 IPC, in Crime No.162 of 2022, seeks anticipatory bail.
2. There are totally fourteen accused in this case, in which the petitioner is arrayed as A9. The case of the prosecution is that due to previous enmity, the deceased one Santhosh was brutally murdered by the accused persons. The accused persons and the petitioner herein were said to have attacked the defacto complainant's son on his head and hand with aruval and other deadly weapons. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and he has been falsely implicated in this case. He further submitted that the petitioner had no motive to murder the deceased, therefore, there is no specific overt act against him. 4. The learned Additional Public Prosecutor submitted that due to previous enmity, the petitioner along with other accused persons had attacked the victim one Santhosh brutally with aruval, in which the said Santhosh died. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Insofar as the petitioner is concerned, he had attacked the deceased with aruval on his head and hand, therefore there is specific overt act against him. Hence, the custodial interrogation of the petitioner is very much required in this case. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
