Petition seeking bail in respect of Crime No.1197 of 2024 registered for the alleged offences punishable under Sections 406, 420 and 120B of IPC is on board for consideration.

2. The learned counsel for the petitioner, pleading innocence on the part of the petitioner, who has been in incarceration since 23.03.2026, seeks the indulgence of this Court. He would submit that there are totally four accused in this case and the petitioner is arrayed as A3. According to the prosecution, the only allegation against the petitioner is that he, along with A4, who is none other than his wife, had introduced the main accused, namely, A1 and A2, to the defacto complainant, who had ultimately cheated the defacto complainant to the tune of Rs.87 lakhs.

The case of the prosecution, as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, is that the petitioner, along with the other accused, had induced the defacto complainant and several others to invest in a business run in the name of "Blessed Enterprises" and collected a sum of Rs.87 lakhs on the promise of high returns and thereafter, neither paid the interest nor returned the principal amount, thereby cheating the defacto complainant. He would further submit that a major part of the investigation has been completed.

4. The learned counsel for the intervenor, while opposing the grant of bail to the petitioner, reiterated the submissions made by the learned Government Advocate (Criminal Side).

Further, having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and the learned counsel for the intervenor, and upon perusing the materials available on record, and considering the period of incarceration undergone by the petitioner, and the fact that the only allegation levelled against the petitioner is that he had introduced A1 and A2 to the defacto complainant, this Court is inclined to grant bail to the petitioner, subject to certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties, each for a like sum, to the satisfaction of the learned District Munsif, Judicial Magistrate, Madhavaram, and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the respondent Police, everyday at 10.30 a.m., for a period of two weeks; 3/6

[c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
