O R D E R

When the matter is taken up, Mr.P.Srinivas, learned standing counsel for the respondent municipality, submitted that the order passed by this Court in W.P.No.34599 of 2004, dated 06.03.2020, has been duly complied with and therefore, the contempt petition may be closed.

However, Mr.B.Gopalakrishnan, learned counsel for the petitioner, submitted that the order passed by this Court has not been fully complied with as the direction of this Court to pay the difference of salary from the date of demotion till the date of suspension has not been paid. In reply, Mr.P.Srinivas, learned standing counsel, stated that in the respondent municipality, there is no difference in scale of pay between JCB driver and the ordinary driver. To frown upon the said submission, learned counsel for the petitioner has not produced any rule or circular for the same.

3. Therefore, recording the submission of the learned standing counsel for the respondent municipality, the contempt petition is closed.
