ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 409, 420, 465, 467, 468 and 471 of IPC in Crime No.140 of 2021, seeks anticipatory bail.
2. Heard both sides.
3. There are totally 5 accused involved in this case and the petitioner is arrayed as A2. The case of the prosecution is that, A1 is working as a Senior Associates Manager in the Hong Kong and Shangai Banking Corporation Limited. The petitioner, along with other accused, has conspired and misappropriated Rs.1,51,77,752/- by misusing the KYC documents by making fabricated documents in the name of non-existing company. Hence, the complaint.
3. The learned Additional Public Prosecutor appearing for the respondent would submit that this is the fifth anticipatory bail petition. Earlier applications filed by the petitioner before this Court in Crl.O.P.No.18500 of 2021, Crl.O.P.No.23066 of 2021 and Crl. O.P.No. 8338 of 2022 were dismissed as withdrawn, respectively and Crl.O.P.No.11353 of 2022 was dismissed on 18.05.2022. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
6. Considering the nature of offence committed by the petitioner and taking note of the fact that this Court had dismissed the earlier applications filed by the petitioner and that there is no change of circumstances. Therefore, this Court is not inclined to grant bail to the petitioner.
