ORDER

This writ petition has been filed challenging the order made in Na.Ka.A/42 /2016 dated 18.08.2020 passed by the 2nd respondent, whereby rejecting the petitioner's request to furnish the certified copies of the documents in respect of the acquisition proceedings.

2.Learned counsel for the petitioner would submit that the petitioner has sought for the certified copy of the award dated 03.03.2017, issued under Section 3(A) 1 of the National Highways Act and the other notifications issued under Sections 4D(1), 3D and 3G (3) of the National Highways Act, from the respondent through his application dated 22.07.2020. Since the same was rejected by the 2nd respondent, the present writ petition has been filed. 3.Learned Standing Counsel appearing for the 3rd respondent would submit that subsequent to the filing of this writ petition, the petitioner had received the compensation for the land acquired from him, through RTGS

Cheque Nos. 000109 and 000110 dated 09.07.2021 of Kotak Mahendra Bank. Therefore, the question of producing the copies of the notification does not arises since the prayer sought for in this writ petition has become infructuous. 4.Heard the learned counsel for the petitioner; learned Additional Government Pleader appearing for the respondents 1 and 2 and the learned Standing Counsel appearing for the 3rd respondent. 5.Considering the submissions made by either parties and upon perusal of the records, it is evident that the issue in the present case is that the petitioner has sought for copy of the award dated 03.03.2017 issued under Section 3(A) 1 of the National Highways Act and the notifications issued under Sections 4D(1), 3D and 3G (3) of the National Highways Act.

Since the 2nd respondent rejected the petitioner's application seeking for the aforesaid notifications, the petitioner has filed this writ petition. However, subsequent to the filing of this writ petition, the compensation has been received by the petitioner for the lands acquired from him through RTGS Cheque Nos. 000109 and 000110 dated 09.07.2021 of Kotak Mahendra Bank, without making any objections. Even then, the notifications sought for by the petitioner were published in the newspaper and therefore issuance of certified copy is not necessary. Therefore, the petitioner can appear before the concerned Authority and receive the same.

6.Such being the case, this Court is of the view that this writ petition is devoid of merits. Thus, no further order is required in the present case since the compensation has been received by the petitioner. 7.In view of the above observations, this writ petition stands dismissed. No costs.
