O R D E R
(This case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1-a) and 4(1-A) of Tamil Nadu Prohibition Act, 1937, in Crime No.1670 of 2020, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 16.08.2020 at about 4 p.m., while the Sub Inspector of Police along with his police party was conducting vehicle check up, the petitioner who came in a bike was found in possession of 10 litres of ID Arrack and on seeing the police he ran away.
3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. 2/4

The learned Additional Public Prosecutor appearing for the respondent would vehemently oppose stating that the petitioner is a habitual offender against whom there are five previous cases pending. 5.Taking into consideration the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed.
