Prayer : Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents, especially, the second respondent to include the name of the petitioner as S.No.26A in between S.No.26 Thiru.G.Paneer Selvam and S.No.27 P.Janaki in the Regular Panel of 'Graduate Typist'/Graduate Record Clerk/Non-Graduate Record Clerk/Office Assistant/Driver/Telephone Operator/ Motor Cycle Messenger fit for appointment to the post of 'Assistant ' under the method by promotion by transfer for the year 2020-21 issued pursuant to G.O(4D) No.35, Personnel and Administrative Reforms (U2) Department dated 21.12.2020 duly considering the Petitioner's concomitant Representations dated 28.12.2020, 30.04.2021 & 08.07.2021, especially the recent one dated 08.07.2021 with all service and monetary benefits.

ORDER

The petitioner's case is that his name has not been considered for the next promotion to the post of Assistant on the ground that the petitioner had not qualified himself in the Foundational Training Course.

The learned counsel for the petitioner submits that the petitioner has indeed qualified himself in the Foundational Training Course in terms of the G.O.Ms.No.7, Personnel and Administrative Reforms (Trg.II) Department, dated 07.01.2020 and the respondents have themselves confirmed the same in their Annexure-IV to Letter No.11537/Trg.II/2020-22, dated 28.04.2021. He submits that his name is at Sl.No.5 in the aforesaid Annexure-IV.

3. The learned Government Advocate for the respondents submits that the first respondent will pass appropriate orders on the representations dated 28.12.2020, 30.04.2021 and reminder dated 08.07.2021 of the petitioner.

4. Recording the same, this Writ Petition is disposed by directing the first respondent to consider the petitioner's representations and dispose the same in the light of the Tamil Nadu Secretariat Service Rules within a period of six weeks from the date of receipt of a copy of this order.
