Second Appeal is filed under Section 100 of the Civil Procedure Code, to set aside the Judgment and decree dated 09.02.2000 made in A.S.No.30 of 1997 by the learned II Additional Judge, City Civil Court, Chennai, confirming the Decree and Judgment dated 07.02.1996 made in O.S.No.4803 of 1986 by the learned XII Assistant Judge, City Civil Court, Chennai. For Appellant : Mr.M.Kamalanathan For Respondent : No appearance
J U D G M E N T
On 21.12.2017, learned counsel for the appellant submitted that the sole appellant was dead and he has filed a memo to that effect. The matter stands adjourned for three weeks for taking steps to bring the legal heirs of the deceased sole appellant on record.
2. Today, when the matter is taken up for consideration, learned counsel for the appellant would submit that though he has taken steps to bring the legal heirs of the deceased sole appellant on record, they are not willing to join to represent the case.
Recording the submission of the learned counsel for the appellant, this Second Appeal is dismissed as abated. No costs. Consequently, connected miscellaneous petition, if any, is closed.
