The present criminal original petition has been filed to call for the records in Cr.No.192/2010 dated 03.02.2010 pending on the file of the first respondent police and quash the same as the same is malafide, Vengenful, vexatious and want of materials.
2. Today, the petitioner along with his counsel on record and the second respondent/de facto complainant are present. Learned Additional Public Prosecutor appearing for the first respondent is also present. The identities of the parties have been verified. dispute between them has been amicably settled. The second respondent has also filed compounding affidavit dated 29.06.2017 signed by the parties to that effect. When this Court enquired the parties, particularly, second respondent / de facto complainant, about the factum and the terms of the compromise, she admitted the same. She also expressed no objection in quashing the FIR in Crime No.192 of 2010 registered against the petitioner herein.
3. In view of the above, this Criminal Original Petition is allowed and the FIR in Crime No.192 of 2010 pending on the file of the first respondent, against the petitioner, is quashed. The compounding affidavit dated 29.06.2017 signed by the parties is taken on record. Consequently, the connected miscellaneous petition is closed.
