This Original Petition has been filed seeking grant of Probate of Will dated 22.02.2019 executed by the paternal uncle of the petitioner, by name T.Gopalan, who died on 25.04.2019. His wife, Radha died on 12.05.2020. The petitioner is the beneficiary under the Will. 2.The respondent is the father of the petitioner. Notice had been directed and counsel had entered appearance and no objection had been stated for grant of letters of Administration. 3.After complying with the formalities, the petitioner was invited to adduce evidence. The petitioner examined himself as PW-1. The death certificate of T.Gopalan was marked as Ex.P5 and the original Will dated 22.02.2019 was marked as Ex.P4. The death certificate of Radha was marked as Ex.P6.

4.The petitioner also examined as PW-2, Hema Varadhan, who was one of the attesting witness. She stated that the deceased T.Gopalan is her brother-in-law. She identified the Will, Ex.P4 and also identified the signature of the testator. She stated that her husband, T.Varadhan attested the https://www.mhc.tn.gov.in/judis

Smv Will as a second attestor. She also stated that the testator had signed the Will in their presence and that he was signed the Will in a sound and disposing state of mind. She had also filed her affidavit and her affidavit was marked as Ex.P11.

4.In view of the evidence adduced, I hold there is every reason to grant the relief sought in the Original Petition namely, granting probate of the Will dated 22.02.2019.
