PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, directing the first respondent to produce the petitioner's daughter Miss.Foumidha, aged about 24 years from the custody of the third respondent and set her at liberty.
For Petitioner : Mr.A.Immanuel For Respondents : Mr.E.Raj Thilak Additional Public Prosecutor
ORDER
(Order of this Court was made by M.S.RAMESH.J,) Alleging that the petitioner's daughter, aged about 24 years is kept under the unlawful custody of the fourth respondent, the present Habeas Corpus Petition has been filed.
2. Since the petitioner's daughter went missing on 23.03.2025, she preferred a complaint before the respondent police and the same was registered in CSR.No.34 of 2025. Subsequently, the petitioner's daughter appears to have married the fourth respondent herein.
3. The learned Additional Public Prosecutor appearing for the respondents 1 to 3 submitted that the petitioner's daughter had married the fourth respondent and appeared before the Superintendent of police, Krishnagiri. He also submitted that the petitioner was also present before the Superintendent of Police, Krishnagiri and was informed that her daughter
had married the fourth respondent herein.
4. In the light of the developments, we do not deem this to be a case of unlawful custody of the petitioner's daughter, who has consciously married the fourth respondent herein on her own choice. As such, no effective orders required to be passed in the present Habeas Corpus Petition.
5. Accordingly, this Habeas Corpus Petition stands closed. [M.S.R., J] [V.L.N., J] 06.06.2025 Index: Yes/No Speaking/Non-speaking order Internet: Yes/No Anu To 1.The Superintendent of Police, Udhagamandalam, 2.The Deputy Superintendent of Police (Law and Order) Uthangarai, Krishnagiri District.
