Order This writ petition has been filed seeking the issuance of a writ of mandamus directing the 2nd respondent to restore the petitioner to the promotional post of Headmistress with effect from 20.01.2014 and to pay the salary applicable to the said post from 01.07.2009, and further to continue to pay the salary attached to the said post by considering the appeals dated 02.08.2018 and 11.02.2020.

2. The petitioner would submit that she was initially appointed as a Secondary Grade Assistant in the Adi Dravidar and Tribal Welfare Department and her services were subsequently regularised. Thereafter, she was promoted as Primary School Headmistress by proceedings dated 23.06.2009 and joined duty at Nandanam School. According to the petitioner, though she was promoted as Headmistress, her pay was not fixed in the scale applicable to the post of Primary School Headmistress. Despite several representations, no orders were passed. The petitioner would submit that during the years 2014 to 2016, pay fixation orders were issued in respect of several Headmasters/Headmistresses under the Department. However, her case was not considered.

The petitioner would further submit that she had been promoted strictly in accordance with her seniority and that several persons junior to her were granted the benefits of pay fixation attached to the post of Headmistress. She would submit that the Primary School Headmaster post carries a distinct pay scale and special allowance and that similarly placed persons had been extended such benefits. The petitioner made a representation dated 02.08.2018 seeking fixation of her pay in the post of Primary School Headmistress with effect from 01.07.2009 and for consequential monetary benefits. Since no orders have been passed on her request, the present writ petition has been filed.

4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents.

Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the 2nd respondent to consider the petitioner's representations dated 02.08.2018 and 11.02.2020 and pass appropriate orders on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.
