ORDER

The petitioner apprehends arrest for the alleged offence under Sections 4(1)(i) of Tamil Nadu Prohibition Act and section 4(1)(A) of the Tamil Nadu Prohibition (Amendment) Act 2024 in Crime No.61 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is arrayed as A2 in this case and the petitioner was found in possession of 200 bottles of brandy. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner was innocent and that he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that one previous cases has been registered against the petitioner. However, he opposed to grant anticipatory bail to the petitioner.

5. I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

6. Considering the facts and circumstances of the case and taking into consideration of the nature of the allegation against the petitioners and the fact that the petitioners has got one previous case, the conduct of the petitioner in

misusing the liberty, this Court is not inclined to enlarge the petitioner on anticipatory bail.

7. Accordingly, this Criminal Original Petition is dismissed. 22-04-2026 SHL To:
