PRAYER:

This petition is filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondents to consider the petitioner's representation dated 09.09.2015 and permit the petitioner to continue his studies in the fourth year B.E., (Mechatronics) course a the Park College of Engineering and Technology, Avinashi Road (NH-47), Kaniyur, Coimbatore District/second respondent herein. ORDER

It is seen that the petitioner was not allowed to write the examination, in view of a criminal case registered against him. By way of an interim order dated 30.10.2015, this Court permitted the petitioner to write the examination.

2. When the matter is taken up for hearing, the learned counsel for the respondent No. 1 submitted that they have no authority to consider the representation of the petitioner dated 09.09.2015. On the other hand, learned counsel for the respondent No. 2 submitted that the petitioner may be permitted to attend classes subject to payment of requisite fees.

3. Considering the above facts, this writ petition is disposed of directing the respondents to publish the results of the petitioner and thereafter, permit the petitioner to continue his studies subject to payment of requisite fees.

4. With the above direction, the writ petition is disposed of. No costs.

rms 15.12.2015 This case having been posted on Friday, The Fifteenth Day of April 2016 Under the caption "For Being Mentioned" and the pursuant to the order of this Court dated 15.12.2015 and made herein and in the presence of the aforesaid Advocates the Court made the following Order;

This writ petition is posted today (15.04.2016) under the caption "for being mentioned" at the instance of the learned counsel appearing for the first respondent, who had submitted that on 15.12.2015, a direction has been granted by this Court in W.P.No.32627 of 2015 as against both the respondents though he had submitted that the first respondent had no authority to consider the representation of the petitioner dated 09.09.2015 and it is also submitted that the petitioner does not have requisite attendance. 3.The order passed by this Court in W.P.No.32627 of 2015 dated 15.12.2015 has to be understood in the context in which it was passed. The question of lack of attendance was not the subject matter of the writ petition. Therefore, it is clarified that the order passed by this Court will not stand in the way of the first respondent in so far as the issue of attendance is concerned to act as per the regulations of University.
