ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of Mandamus to direct the respondents 2 and 3 to shift the EB Polls in petitioner's properties comprised in Survey No.S.No.85/2 Nallampalli Village, Dharmapuri District by considering the fees paid by the petitioner on 04.08.2025.

3. It is submitted by the learned counsel for petitioner that respondents have erected 10 EB poles in the subject property situated in Survey No.85/2, Nallampalli Village, Dharamapuri District. It is stated that on 11.02.2025, petitioner requested the respondents to shift the EB poles through online mode. It is further submitted that the subject property was inspected by the authorities and an estimation report was given by the respondents on 04.08.2025 for shifting the poles, amounting to Rs.1,74,192/-. It is the case of the learned counsel for petitioner that petitioner has remitted the appropriate fees for the same and further submitted a letter dated 08.07.2025 before the respondents, however, no action has been taken by the respondents till date. Aggrieved by the same, petitioner has come before this Court.

4. At the outset, it was submitted by the learned Government Advocate

for respondents that there is some title dispute over the subject property. He would further submit that the representation/ letter submitted by petitioner dated 08.07.2025 would be considered and appropriate orders would be passed by the authority concerned after issuing notice to petitioner and other interested parties. Agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to respondents, to consider the representation/letter submitted by petitioner dated 08.07.2025, on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to the petitioner and other interested persons in the Civil dispute/ appeal. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
