This petition has been filed seeking to condone the delay of 350 days in filing the appeal.

2. Heard the learned counsel for the petitioners.

3. The learned counsel for the third respondent has raised objections in allowing the petition.

4. The first petitioner would aver that due to this accident, she lost her son. After that her husband went to neighbouring state for gardening work. Hence, the delay of 350 days occurred, which is not wanton. Meanwhile, due to her financial condition and ill health, the said delay was caused, which is not willfull.

5. The reasons mentioned in the affidavit appear to be reasonable and acceptable. Hence, this Court is inclined to allow this Civil Miscellaneous Petition and the delay of 350 days is condoned on condition to waive the interest for the delay period. 25.09.2025 kmm https://www.mhc.tn.gov.in/judis
