Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the second respondent to dispose of the representation dated 04.09.2023 submitted by the petitioner to rectify the error crept in the extent of land proposed for acquisition of land comprised in then Survey No.58/1, present Survey No.97/5, Neelangarai Village, Tambaram Taluk, presently Sholinganallur Taluk, for the formation of 6 way lane from Thiruvanmiyur to Akkari by the notice bearing Na.Ka.No.130/2007/E1 dated 08/2023 signed on 17.08.2023. 1/4

By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.

This Writ Petition is filed to direct the second respondent to rectify the error crept in the extent of land proposed for acquisition comprised in Old Survey No.58/1, New Survey No.97/5, situated at Neelangarai Village, Tambaram Taluk, presently Sholinganallur Taluk, by considering his representation dated 04.09.2023 . 3.

Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

The grievance of the petitioner is that though an extent of 63sq.metres of land were earmarked for acquisition, while issuing notice, the extent has been shown as 47 sq.metres. In this regard, the petitioner has given representation on 04.09.2023 to set right the mistake crept in the 2/4

extent of land. However, the same has not been considered by the second respondent. Hence, the present Writ Petition. 5.

Mr.A.Selvendran, learned Special Government Pleader for the respondents would submit that the second respondent will consider the representation of the petitioner and pass orders in a reasonable time. 6.

In such view of the matter, there shall be a direction to the second respondent to consider the representation of the petitioner dated 04.09.2023 and pass appropriate orders, on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No costs.
