The prayer in the present petitioner is for a direction to the police to investigate in the civil dispute. In my view the issue as to whether the averments in the complaint constitute a cognizable offence under Section 482 of the Criminal Procedure Code or not and it is always open to the petitioner herein to appear before the Investigation Officer to put forth his grievances.
