This petition is filed to condone the delay of 276 days in filing the appeal.

Heard Mr.T.S.Arthanareeswaran, learned counsel for the petitioner.

There are three respondents in the present petition. According to the learned counsel for the petitioner, respondents 1 and 2 were set ex parte by the Tribunal and therefore, they are not contesting respondents. Accordingly, their array of parties in the causetitle be dispensed with. However, private notice sent by the petitioner has been returned with an endorsement that respondents 1 and 2 died. Be that as it may, since respondents 1 and 2 are no necessary parties, according to the petitioner, they have been removed from the array of parties. Respondent 3 has also been served and Mr.Senthilkumar, learned counsel has taken notice for respondent 3.

The delay is only 276 days. Having been satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 276 days in filing the appeal is condoned.

Accordingly, the petition stands ordered.
