Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the second respondent in his proceedings in Na.Ka.No.2672/B3/2024 dated 14.05.2024 and quash the same and consequently direct the respondents herein to issue fresh educational certificates of the petitioner with correct date of birth of the petitioner as 02.08.1970 instead of 02.06.1970. For Petitioner : Ms.M.Jayanthi for Mr.V.Prasad For R1 to R5 : Mr.S.Prabakaran Government Advocate For R6 : Mr.S.Gopinathan O RDER This Writ Petition has been filed challenging the proceedings in Na.Ka.No.2672/B3/2024 dated 14.05.2024 and quash the same and consequently direct the respondents herein to issue fresh educational certificates of the petitioner with correct date of birth of the petitioner as 02.08.1970 instead of 02.06.1970.

2. Heard the learned counsel for the petitioner, the learned Government Advocate for the respondents 1 to 5 and the learned counsel for the 6th respondent and perused the materials available on record.

3. The petitioner was born on 02.08.1970 along with her sister as twins.

The Date of Birth was duly registered and birth certificates were also issued by the competent authority as 02.08.1970. Though the petitioner and her sister submitted their birth certificate as their date of birth as 02.08.1970 during their admission into the School, in the mark sheet of the petitioner herein, it was mentioned as 02.06.1970 instead of 02.08.1970. It was not noticed by the petitioner and she joined Diploma in the department of Technical Education and completed the same. They had one elder brother who died during his employment as a bachelor. In order to claim the death-cum-retirement benefit and other monetary benefits payable to the deceased brother, the petitioner and her sister applied for the same with all education certificates. The revenue authorities verified the certificates and pointed out that the petitioner's date of birth was given as 02.06.1970 instead of 02.08.1970. But her sister's date of birth was rightly mentioned as 02.08.1970.

4. A perusal of the birth certificate of the petitioner and also other records revealed that the petitioner and her sister one T.Lalitha are twins. They were born on 02.08.1970. Further, the petitioner did not claim to change the date of birth in her mark sheet for any other purpose. The petitioner and her sister claim the death-cum-retirement and monetary benefits of their deceased brother.

5. Considering the facts and circumstances of the case, the impugned order cannot be sustained and is liable to be set aside. Accordingly, the proceedings in Na.Ka.No.2672/B3/2024 dated 14.05.2024, is hereby set aside. The second respondent is directed to issue fresh Transfer Certificate, SSLC mark sheet and other educational certificates with correct date of birth viz., 02.08.1970 instead of 02.06.1970, within a period of four weeks from the date of receipt of a copy of this order.
