Respondent The writ petition is filed under Article 226 of the Constitution of India praying for the issue of a writ of mandamus to direct the respondent herein to dispose of the petitioner's representation dated 3.6.2016 seeking release of his vehicle, i.e. Tipper Lorry bearing registration No.TN 21 AX 9614 and hand over the same to the petitioner within the time frame to be stipulated by the Court.

ORDER

Heard Mr.G.Magesh Kumar, learned counsel for the petitioner and Mr.R.Lakshmi Narasimhan, learned Additional Government Pleader, accepting notice, for the respondent. The petitioner, who is the owner of the Tipper Lorry bearing Registration No.TN 21 AX 9614, seeks for a positive direction to release his vehicle, which is said to have been seized by the respondent on the allegation that it was carrying on illicit mine sand. However, at this stage, no positive direction can be granted. But, this court is inclined to direct the respondent to consider the petitioner's representation, dated 3.6.2016, which has been sent by speed post on 6.6.2016. In the light of the above, there shall be a direction to the respondent to consider the petitioner's representation dated 3.6.2016 within a period of 10 days from the date of https://hcservices.ecourts.gov.in/hcservices/

receipt of copy of this order. The petitioner is directed to furnish a copy of the representation along with a copy of this order to the respondent by appearing in person. Accordingly, the writ petition is disposed of. No costs.
