ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition is filed to direct the second respondent to consider the representation of the petitioner dated 04.03.2024 and to cancel the patta issued to the fifth respondent with respect to the land measuring 1.87 acres comprised in S.No.515, Periyanahalli Village, Karimangalam Taluk, Dharmapuri District, retrieve the said land and issue patta to the petitioner.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 4 and perused the materials available on record.

4. The case of the petitioner is that subject property has been assigned to the father of the petitioner and after the death of his parents he succeeded to the said land. While so, the patta has been illegally transferred to the name of the fifth respondent. In the regard, the petitioner has given a representation to the first and second respondents. But the same has not been considered by them. Hence, the present Writ Petition.

5. Considering the limited prayer sought for in the Writ Petition, without going into the merits of the case, the second respondent is directed to consider the representation of the petitioner dated 04.03.2024 and pass Order on merits and in accordance with law, after giving opportunity to the petitioner and the respondents 5 to 8, within a period of two months from the date of receipt of a copy of the Order.
