Respondents Prayer: This Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus directing the respondents to pay subsistence allowance to the petitioner from the date of his suspension on 21.02.2018, by considering the representation dated 03.12.2018 of the petitioner and consequently forbear the respondents from conducting any inquiry without payment of subsistence allowance to the petitioner pursuant to the proceedings in Na.Ka.No.1912/2021/Po.Pa.Ni.Ni, dated 2106.2021 of the first respondent.

(The case has been heard through video conference) By consent of the learned counsel on either side, this writ

petition is taken up for final disposal and is disposed of by means of this order.

2. Mr.C.Kathiravan, learned Government Advocate accepts notice on behalf of the respondents.

3. The petitioner has filed the present writ petition seeking a Mandamus, directing the respondents to dispose of the petitioner representation dated 03.12.2018, seeking payment of subsistence allowance from the date of his suspension on 21.02.2018 and consequently forbear the respondents from conducting any inquiry without payment of subsistence allowance to the petitioner pursuant to the proceedings in Na.Ka.No.1912/2021/Po.Pa.Ni.Ni, dated 2106.2021 of the first respondent.

4. This Court heard the submissions of the learned counsel appearing on either side.

This Court considering the limited prayer sought for in this Writ petition, without going into the merits of the case, direct the respondents to consider and dispose of the representation of the petitioner dated 03.12.2018, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner herein.

6. With the above directions, this writ petition is disposed of. Consequently, the connected miscellaneous petition is closed. No costs.
