This petition is filed to condone the delay of 420 days in filing the appeal.

2. The respondent was served and name of the counsel for the respondent is also printed in the cause list. None appears on behalf of the respondent.

3. In view of the reasons found mentioned in the affidavit filed in support of the Miscellaneous Petition and taking into account the submission made by the learned counsel for the appellant that the petitioner has been paying maintenance to the respondent even after the order dated 17.01.2017 @ Rs.5,000/- per month, the delay is condoned.

The Miscellaneous Petition is allowed.
