ORDER

This Criminal Original Petition has been filed challenging the impugned notice dated 07.01.2025 (as per ecourts entry Crl.M.P.4657 of 2024) (as per the impugned notice in CMP No.4657 of 2024) CMP No.4657/2024 pending on the file of the Court of the Learned Judicial Magistrate No.1, Kallakurichi and to quash the same.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the materials placed on record.

3. It is seen that the respondent filed a complaint and the same has been taken on file in CMP No.4657 of 2024, on the file of the Judicial Magistrate No.1, Kallakurichi and issued notice before taking cognizance as contemplated under Section 223 of BNS, 2023.

4. In view of the above, this Court finds no infirmity or illegality in the impugned notice dated 07.01.2025 on the file of the Judicial Magistrate No.1, Kallakurichi. However, the petitioner can very well appear before the Judicial Magistrate No.1, Kallakurichi and put forth the case before taking

cognizance.
