Crl.O.P.No.4413 of 2015 R.S.Ramanathan,J., This matter is listed today under the caption, "For Being Mentioned", at the instance of the learned counsel appearing for the petitioner.
2. It is submitted by the learned counsel appearing for the petitioner that this Court, by order, dated 26.02.2015, disposed of this Petition by passing usual order. But due to inadvertence, para No.3 of the order has been wrongly typed. Hence, the learned counsel submitted that the same may be rectified.
3. Heard the abovesaid submissions and this Court also gone through the order passed by this Court in Crl.O.P.No.4413 of 2015. In view of the same, this Court directs the Registry to substitute para Nos.3 and 4 of the order passed in Crl.O.P.No.4413 of 2015 with the following Para:- " Considering the allegations made in the complaint and in view of the dictum laid down by the Hon'ble Apex Court in re Lalita Kumari vs. Govt. of U.P. & others reported in [2013 (4) Crimes 243 (SC)] which has to be followed in letter and spirit viz., that if a cognizable offence is
made out, the respondent-Police is duty bound to register a case, this Criminal Original Petition is disposed of, by directing the respondent to register the case on the basis of the petitioner's complaint dated 16.08.2014, which was given CSR number and investigate the same in accordance with law. "
4. Registry is directed to give amended order on or before 20.03.2015.
