ORDER

The instant writ petition has been filed by the petitioner to refix petitioner's seniority as per the proposal of the Assistant Commissioner dated 19.01.2024.

2. It is the submission of the petitioner that he was appointed as Grade-IV Executive Officer in the Hindu Religious and Charitable Endowments Department dated 01.07.2010, and subsequently promoted to Assistant. While so, without including the petitioner in the panel for promotion, promotions were given to 20 persons. In pursuance thereof he has given representation to the Assistant Commissioner, who then sent a proposal to the Commissioner to refix the petitioner's seniority.

3. The learned Additional Government Pleader appearing on behalf of the

Hindu Religious and Charitable Endowments Department would submit that the petitioner had not completed one year in the post of Assistant, hence he was not considered during 2015-2016.

4. However, it is pertinent to mention here that the Assistant Commissioner vide in his order dated 19.01.2024 sent a proposal to the Commissioner to refix the seniority of the petitioner as done to Smt.Anusha Devi and such proposal is still pending with the Commissioner.

5. In view of such circumstances, instead of going into the merits of the matter, this Court deemed it appropriate to direct the Commissioner, Hindu Religious and Charitable Endowments Department, Chennai to pass orders upon the proposal sent by the Assistant Commissioner vide in his letter dated 19.01.2024, according to its own merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.

6. With the above directions, the Writ Petition stands disposed of. No costs.
