The learned counsel for the 1st respondent has no objection. However, learned senior counsel appearing on behalf of the 4th and 5th respondent would submit that the reasons given in the affidavit filed in support of the application is not convincing.

2. Heard the learned counsel and a perusal of the affidavit filed in support of condone delay petition would reveal that the delay has occurred on account of the serious health condition of the petitioner as well as the fact that his wife was also undergoing serious gynaec problems.

3. The reasons given appears adequate and sufficient, hence the delay is condoned.

4. The Registry is directed to print the name of the learned counsel when the C.M.P is listed and number the appeal if it is otherwise in order.
