Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the first respondent to pass an appropriate order on the petitioner's son's representation dated 20.12.2017 by way of cancelling the registered forged documents by the respondents 7 to 9 herein
vide Document No.1322/2005, Document No.1024 of 2006 and Document No.2692 of 2011 dated 06.10.2005, 13.7.2006 and 09.11.2010 respectively on the file of the fifth respondent and to direct the fourth respondent to restore the revenue records related to the land situated in the Survey Nos.454 and 455 of Nagamangalam Village, Denkanikottai Taluk, Krishnagiri District to petitioner name based upon petitioner patta vide Patta No.781. ORDER
This writ petition has been filed seeking a mandamus directing the first respondent to pass an appropriate order on the petitioner's son's representation dated 20.12.2017 by way of cancelling the registered forged documents by the respondents 7 to 9 herein vide Document No.1322/2005, Document No.1024 of 2006 and Document No.2692 of 2011 dated 06.10.2005, 13.7.2006 and 09.11.2010 respectively on the file of the fifth respondent and to direct the fourth respondent to restore the revenue records related to the land situated in the Survey Nos.454 and 455 of Nagamangalam Village, Denkanikottai Taluk, Krishnagiri District to the petitioner's name vide Patta No.781.
2. When the matter was taken up, the learned Additional Government Pleader submitted that the prayer in the writ petition is not legally maintainable, since the power to cancel the registered document extended in Circular No.67 dated 3.11.2011 has been recalled in the latest circular issued by the office of the Inspector General of Registration, Chennai in Letter No.41530/U1/2017 dated 8.11.2017. Therefore, the petitioner has to move the appropriate authority viz., the District Registrar (Admn.) to lodge his complaint against the alleged fraudulent registration.
3. Recording his statement, this writ petition stands dismissed. However, the petitioner is at liberty to approach the civil Court to establish his title in the manner known to law. No costs.
