O R D E R

This Criminal Original Petition is filed to quash the F.I.R. in Crime No.71 of 2025 on the file of the 1st respondent-Police.

The learned counsel for the petitioner submitted that, on 16.03.2025, when the petitioner along with his wife and son were in their house, the de-facto complainant's father, brother and sister went to the house of the petitioner and scolded them in unparliamentary words and also threatened and attacked them with deadly weapons and that the petitioner lodged a complaint against them. He further submitted that in order to escape from the clutches of law, as a counter blast, the de-facto complainant had lodged a false complaint against the petitioner, subsequently, the same was registered by the first respondent-Police in Crime No.71 of 2025 for the offences punishable under Sections 296(b) and 115(2) of the BNS, 2023. However, no ingredients are made out against the petitioner for the alleged offences.

3. Learned Government Advocate (Crl.Side) appearing for the first 2/5

respondent-Police, on instructions, submitted that the investigation in both cases in Crime Nos.70 and 71 of 2025, is over and charge sheets have already been filed before the learned Judicial Magistrate No.II, Dharmapuri through e-filing on 19.05.2025 and 21.05.2025.

4. Since the first respondent-Police has completed the investigation and filed the charge sheet, nothing survives for adjudication in this Criminal Original Petition. However, the petitioner is at liberty to work out his remedy in the manner known to law.

5. With the above liberty, the Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 19.06.2025 Index : Yes/No Speaking Order : Yes/No ms 3/5
