PRAYER: Criminal Revision Case is filed under Sections 438 r/w 442 of the Criminal Procedure Code, 1973, to call for the records dated 27.03.2025 in Metropolitan Magistrate Fast Track Court No.2, Allikulam, Chennai and set aside the same.

O R D E R

This revision has been preferred against the order dated 27.03.2025 in Metropolitan Magistrate Fast Track Court No.2, Allikulam, Chennai, thereby dismissed the petition filed under Section 270 of BNSS, by the petitioner, seeking permission to examine the Sub-Inspector of Police, Karuppaurani Police Station.

Heard the learned counsel appearing on both sides and perused the materials available on record.

The petitioner is the accused in STC.No.8520 of 2024, pending on the file of the Metropolitan Magistrate, Fast Track Court No.2, Allikulam, Chennai, arising out of the complaint filed for the offence under Section 138 of the Negotiable Instruments Act, 1881.

During the pendency of the trial, the petitioner filed an application under Section 270 of BNSS, seeking permission to examine the Sub-Inspector of Police, Karuppaurani Police Station, Madurai District, in order to establish that a complaint was lodged by him and a Community Service Register (CSR)

receipt was issued.

The Trial Court dismissed the said petition, observing that the petitioner had already produced the certified copy of the CSR issued by the said Police Station, and the same had been marked as defense evidence. Therefore, examining the Sub-Inspector of Police, Karuppurani Police Station, Madurai, was unnecessary.

This Court finds no illegality or infirmity in the order passed by the Trial Court. The CSR, being marked through the defense evidence, serves the intended purpose, and summoning the Sub-Inspector would only delay the trial without any added evidentiary value.

In view of the above, the order dated 27.03.2025 in Metropolitan Magistrate Fast Track Court No.2, Allikulam, Chennai, is hereby confirmed.

Accordingly, this Criminal Revision Case is dismissed.
