PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus directing the Respondents to provide adequate police protection to the petitioner and petitioner's family members from threats of the 3rd respondent and his henchmen, considering petitioner's representation dated 15.03.2023 given to the respondents in person and subsequently complained to the 2nd respondent on 18.05.2023 in person.

O R D E R

The Writ Petition has been filed to direct the Respondents to provide adequate police protection to the petitioner and petitioner's family members from threats of the 3rd respondent and his henchmen by considering petitioner's representation dated 15.03.2023

2. The learned counsel for the petitioner submitted that, petitioner purchased a flat bearing No.3F, Third Floor, Shanmugam Flats, Paari Saai, Mohappair East, Chennai - 600 037 from the 3rd respondent for valuable consideration. After sale, 3rd respondent requested the petitioner to give some time for handing over the possession of the property. Considering to his requests, 3rd respondent was permitted to stay there at monthly rent of Rs.12,000 per month. Despite giving sufficient time, 3rd respondent has not chosen to vacate the premises. When he was asked to vacate the premises, he made life threat to the petitioner. Thereafter, petitioner gave a representation to the respondent police seeking police protection, since, no action was taken on his representation dated 15.03.2023, present petition is filed.

3. In response, learned Government Advocate (Crl. Side) submitted that, on the basis of the representation given by the petitioner, both the petitioner and the 3rd respondent appeared for the enquiry and they had given written undertaking that they will resolve the dispute before the competent Court.

4. In view of the submissions made by the learned Government Advocate (Crl. Side), this Criminal Original Petition is disposed of giving liberty to the petitioner to approach the competent Court for appropriate remedy.
