ORDER
[Order of the Court was made by M.SUNDAR, J.] Ms.R.Priyadharshini, learned counsel representing Ms.S.Meenakshi, counsel on record for writ petitioner, Mr.T.K.Saravanan, learned Additional Government Pleader R1 and R3 and Mr.K.Palaniappan, learned counsel for R2 are before this Court.
2. A 'notice dated 17.05.2024 issued by R2' [hereinafter 'impugned notice' for the sake of convenience] alleging encroachment and calling upon the noticee to remove the encroachment has been assailed by the writ petitioner. A scanned reproduction of the impugned notice is as follows: Page Nos.2/6

3. Mr.K.Palaniappan, learned counsel for R2, on instructions, submitted that the impugned notice is being withdrawn as survey number has been wrongly mentioned but learned counsel seeks leave to preserve the rights of R2 to issue notice afresh.
4. We permit R2 to withdraw the impugned notice. We record the withdrawal and as regards the request of R2 to preserve rights to issue notice afresh, the same is acceded to with a rider that R2 can do so to the extent permissible in law.
5. If R2 issues notice afresh, all rights and contentions of writ petitioner and /or any other noticee will stand preserved and the same stand preserved untrammelled by this order.
6. Captioned writ petition disposed of as closed recording the stated position of R2. Consequently, captioned WMP becomes otiose and the same is disposed of as closed.
